Most home-based businesses in Loudoun must register for local business taxation, and many also need a home-occupation zoning permit.
Outside an incorporated town, a new business must register with the Loudoun Commissioner of the Revenue within 30 days of starting operations. The first-year BPOL charge is generally $30. Home-based businesses with gross receipts of $10,000 or less are exempt from that $30 fee, but the county says they still must report annually and register for business personal property tax. Computers, furniture, tools and other assets used or available for business can be reportable even when they were originally bought for personal use.
The zoning question is separate. Loudoun’s Home Occupation Permit costs $165. The county allows one full-time-equivalent nonresident employee if an additional off-street parking space is available. The business may use no more than 25% of the dwelling’s gross floor area, may not create off-site noise, fumes, glare, vibration or electrical interference, and may not generate traffic beyond what is normally expected in a residential neighborhood. Retail sales are generally prohibited except for items handcrafted on the premises.
If the property is inside Leesburg, Purcellville, Middleburg or another incorporated town, apply through the town; the county does not issue the home-occupation zoning permit there. County business personal property obligations may still apply. HOA covenants or a lease can also be more restrictive than zoning, so government approval does not override a private agreement.
Regulated activities need additional review. Child care, food production, professional services, contracting, beauty services and other businesses may require state licensing, health approval, building or fire review. A home occupation permit is not a substitute for those approvals.
Before announcing the opening, make a four-column checklist: entity and trade name, local tax registration, land-use permission, and industry licensing. Confirm whether customers will visit, inventory will be stored, a sign will be used, deliveries will increase or an employee will work onsite; those facts can change the zoning analysis.
The easiest path is to contact the county Business Assistance Team and Commissioner of the Revenue with a precise description of the activity and address. A home business can be inexpensive to start, but “small” does not mean exempt. Correct registration protects the owner from penalties and prevents a zoning surprise after customers arrive.
